This privacy policy (hereinafter referred to as “Policy“) is provided in compliance to art. 13 of the General Data Protection Regulation EU 2016/679 “GDPR” and any subsequent amendments and additions, from Lightstreamer S.r.l. headquartered in Milano, Italy, 20124, Via Panfilo Castaldi 11, fiscal code and VAT n. 03585950102 (hereinafter referred to as “Lightstreamer“) to the user (hereinafter referred to as “User) of the lightstreamer.com website (hereinafter referred to as “Website“).

Lightstreamer is the Data Controller of the personal data collected and processed, as detailed below.

What personal data we collect and why

When you navigate our website

The Website collects some data when a User calls up the Website, which are stored in server log files. Such data include the IP address of the User, the browser type and version, the operating system, the referrer and any data that the User’s browser sends as part of the navigation activity on the Website. This data is needed to deliver the content of the Website correctly, to provide law enforcement authorities with the necessary information in case of a cyber-attack, and to perform anonymous statistical analyses.

When you contact us

If a User contacts Lightstreamer via email, via a contact form, or via a live chat, the personal data transmitted by the User on a voluntary basis are automatically stored and used for providing answers to the User and for any subsequent communication.

When you subscribe to our newsletter

On the Website, Users are given the opportunity to subscribe to our newsletter, to stay informed on news regarding Lightstreamer. An email will be sent to the email address registered by the User to confirm the email address, as part of a double opt-in procedure. The personal data collected when subscribing to the newsletter are: email address, first name (optional), last name (optional), and IP address.

The newsletter contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such emails, which allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, the Data Controller and Data Processor may see if and when an email was opened by a User and which links in the email were called up by the User.

The subscription to our newsletter may be terminated by the User at any time, by following a link provided in each newsletter. It is also possible to communicate the revocation to Lightstreamer via email or registered mail.

When you register for our forum

The Website offers a discussion forum where registered Users can participate and post public messages. To complete the registration process, an email will be sent to the User’s email address as part of a double opt-in procedure to confirm the registration. The personal data collected during registration includes the User’s email address, chosen username, and password, and IP address. Users may provide additional personal data voluntarily by filling out their public user profile on the forum, but such data is not mandatory to use the forum.

Please note that any information you choose to disclose in the forum becomes public information. We strongly advise caution when sharing personal details, as we are not responsible for how others may use the information you choose to post.

The processing of your data for participation in the forum is based on your consent, in accordance with Article 6, paragraph 1, letter (a) of the GDPR. You may withdraw your consent at any time; however, this will not affect the lawfulness of processing based on consent before its withdrawal.

When you chat on our site

The Website uses Now4real to enable visitors to chat with each other in real time. Lightstreamer acts as an autonomous Data Controller with regard to the processing of chat data (please see https://now4real.com/privacy-details/#visibility to know the details of what personal data Lightstreamer, which is the Publisher, processes). We can access chat data with a maximum time span of 12 months on a rolling basis and we use such data for the same purposes and with the same means applicable in the case of information made publicly available on the Internet by anyone. When you comment on our blog

The Website provides a blog, which allows Users to publish comments below each blog post. The commenting system is not provided by Lightstreamer but by a third party called Disqus, a US-based company. Registration to Disqus, login to Disqus, and any personal data collected as part of the Disqus experience are directly and completely managed by Disqus. Lightstreamer does not act as a Data Controller for the personal data managed by Disqus. Please see the privacy policy of Disqus, available on their site (https://disqus.com), before using this service.

When you use our demos

The Website contains some technology demonstrations (called “demos”). Some of the demos can be used online, directly on the Website’s pages, while others need to be downloaded on User’s mobile devices or computers. When the User uses a demo, we store the IP address of the User in server log files and we might enable remote logging for diagnostic purpose, but no personal data, except for the IP address, are reported.

Some of the demos include chat features. For all the chats, the IP address of the User is collected and stored together with the published chat message, to provide law enforcement authorities with such data if required. In some chats, the IP address is publicly displayed, if this is a specific feature of that type of chat. Please remember that any information you disclose in the chat becomes public information and we are not responsible for the use of any information that you choose to post to our chats.

Some demos provide push notifications. If the User makes use of them, a unique token identifying the mobile device, the computer, or the browser is stored on an internal database. No personal data, not even the User’s IP address, is associated with the token, and it is stored only for the purpose of sending push notifications. The token may be shared with third-party services, such as Google Firebase or Apple APNs, again only for the purpose of sending push notifications. When the User unsubscribes or disables push notifications, either via the demo’s controls or via the device or browser settings, the token is automatically deleted with a calendar week.

How we process personal data

The Data Controller declares and guarantees that the Personal Data provided by the User will be treated with the strictest confidentiality and protection, also ensuring that appropriate security measures, of both technical and organizational nature, will be taken aimed at preventing access, disclosure, accidental or improper alteration, unauthorized loss or destruction of Personal Data. Personal Data may be processed by the Data Controller in manual, paper or electronic form. Specific security measures are observed by the Data Controller to prevent data loss, illicit or incorrect use and unauthorized access.

Our IT infrastructure is based on cloud services provided by third-party companies, which act as Data Processors on behalf of Lightstreamer. Such Data Processors are all GDPR compliant and are based either in EU or in US (with the Standard Contractual Clauses in place).

The Website is protected via encrypted TLS connections.

Without prejudice to User’s right to oppose to the processing of Personal Data and/or require cancellation, Personal Data provided hereof are processed and stored for the time required by the purposes described in this Policy.

Rights of the users

In relation to Personal Data collected, the User is entitled to exercise the following rights:

  • Right of access : the right to verify which and which type of Personal Data are collected and stored by the Data Controller, for what purpose they are used, where they are collected and to whom they have been communicated.
  • Right to rectification and/or integration : the right to obtain from the Data Controller the correction and/or the integration of Personal Data concerning and provided by the User. The Data Controller makes reasonable efforts to ensure that the Personal Data collected are accurate, complete, up-to-date and relevant, based on the most recent information available.
  • Right of limitation : the right to obtain from the Data Controller a limitation on the processing of User’s Personal Data if:
  • Right to portability:  following specific request of the User, the Data Controller will transfer Personal Data to another data controller, if technically possible, provided that the processing is based on the specific consent of the User and/or is necessary for the execution of a contract.
  • Right to cancel : the right to obtain from the Data Controller the cancellation of your personal data if:
  • Right to Opposition : the right to object to the processing of Personal Data at any time, provided that the processing is not based on User consent but on the legitimate interests of Lightstreamer (as Data Controller) or third parties. In such cases, the Data Controller will no longer retain User’s Personal Data unless it is possible to demonstrate binding and legitimate reasons and an overriding interest in the treatment or establishment, exercise or defense of a right in court. If you oppose the treatment, please specify if you intend to cancel your personal data or limit its processing by Lightstreamer;
  • Right to lodge a complaint : in case of alleged violation of the current privacy law, the User may lodge a complaint with the competent authorities of his country or of the place where the alleged violation would have occurred.

The Data Controller must reply to the request given by the User, for any rights the User may exercise (including the right of access), within 1 (one) month from receiving the specific request. This timeline is extendable up to 3 (three) months in cases of particular complexity. In any case, the Data Controller must however give feedback to the User within 1 (one) month from the request, even in case of denial.

The feedback must be generally given to the User in written form also through the use of electronic tools that facilitate accessibility; it can only be given orally if the User so requires.

Disclosure

Please keep in mind that Lightstreamer may disclose Personal Data of the Users to the extent that it is required to do so by law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise or defend its legal rights.

Furthermore, this Policy does not apply to personally identifiable information or personally sensitive data you disclose through our public online forums and public online chats; if you do so, be aware that this information may be collected and used by others.

A cookie is a simple text file that is stored on your computer or mobile device by a website’s server and only that server will be able to retrieve or read the contents of that cookie. Each cookie is unique to your web browser. It will contain some anonymous information such as a unique identifier and the site name and some digits and numbers.
